Terms of Use

These Terms of Use ("Terms") govern your use of the Flame iOS application ("Flame", "the app") operated by Penny Development ("we", "us"). By using Flame, you agree to these Terms.

1. The service

Flame helps you generate recipes and meal plans using AI based on preferences you provide. Features may differ between the free tier and Flame Plus (paid subscription). The app may generate dish photos, nutrition estimates, beginner-friendly cooking steps, and allergen safety notes using third-party AI and data services described in our Privacy Policy.

2. Not professional advice

Recipes, nutrition estimates, allergen warnings, calorie guidance, and meal suggestions are for informational and entertainment purposes only. They are not medical, dietary, allergy-testing, or safety advice. You are responsible for:

Checking ingredients for allergens and dietary restrictions
Following safe food handling and cooking practices
Verifying nutrition information if you rely on it for health decisions
Confirming that AI-generated allergen notes do not replace reading labels or consulting a professional

AI-generated content may be inaccurate, incomplete, or unsuitable for your needs.

3. Accounts and eligibility

Remote recipe generation requires Sign in with Apple. We associate your use with a pseudonymous Apple identifier to provide the service and enforce usage limits. You must be able to form a binding contract in your jurisdiction. The app is not intended for children under 13.

4. Subscriptions (Flame Plus)

Plus is billed through Apple's App Store as an auto-renewing subscription (monthly or annual).
Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
Manage or cancel in Settings → Apple ID → Subscriptions.
Refunds are handled by Apple per their policies.
We may change subscription features or pricing with notice where required by law or App Store rules.
Plus removes ads and unlocks additional features such as meal plans and nutrition tools as described in the app.

5. Free tier and ads

The free version includes daily generation limits and shows ads via Google AdMob. This includes a full-screen interstitial shown once before you view a newly generated recipe (not when reopening saved recipes), plus optional rewarded video ads for extra generations. If an ad fails to load, you may still view your recipe. Ad availability is not guaranteed. Plus subscribers do not see ads.

6. Acceptable use

You agree not to:

Reverse engineer, scrape, or abuse the API
Use the app to generate harmful, illegal, or harassing content
Circumvent usage limits, session requirements, or subscription requirements
Submit prompts designed to manipulate or attack the AI system
Share or resell access tokens or attempt to impersonate another user

7. Intellectual property

The app, branding, and underlying software are owned by Penny Development or its licensors. Generated recipe text and images are provided for your personal, non-commercial use unless we agree otherwise in writing. Third-party services (OpenAI, DeepSeek, Cloudflare, etc.) may have their own terms governing outputs on their systems.

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF RECIPES, ALLERGEN WARNINGS, OR NUTRITION INFORMATION. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (OR USD $50 IF YOU USE THE FREE TIER).

10. Termination

You may stop using the app at any time. We may suspend or discontinue the service if you violate these Terms or if required for legal or operational reasons.

11. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country require otherwise.

12. Changes

We may update these Terms. Material changes will be reflected by the "Last updated" date. Continued use after changes constitutes acceptance.
